CEMETERY RULES & REGULATIONS

- The lot owner is responsible for the monument on the owned lot. The owner will maintain it so as to present no safety hazard. The Cemetery Board is not responsible for installing, maintaining, or repositioning monuments. All monuments must have a cement foundation of sufficient size and depth to prevent the monument from shifting. Caretaker will do all foundations, footers, excavating and graves.
- Vaults must be pre-approved by the Caretaker (wooden boxes/non-sealed lid/vaults are not approved). A liner (plastic, fiber-glass, asphalt, etc.) or sealed lid/vault is required.
- The Cemetery Board restricts burial to the following conditions per grave plot: One adult vault or
One child vault or
Two cremation urns
All cremains to be buried by caretaker - All graves should be marked with a permanent marker showing the name and date of death.
- No digging will be permitted without the permission and coordination of the Caretaker.
- No animals or pets are to be buried in the Cemetery.
- Seasonal flowers and decorations will be removed after April 11th
- The Cemetery should be treated with respect.
- The Cemetery will be closed from dust to dawn.
- The sale or transfer or any interment right by any owner or purchaser, shall not be binding upon the cemetery
unless same shall first be duly approved in writing by the properly authorized officer of the cemetery. This
procedure is required in order that the cemetery may at all times have a complete and accurate record of all
owners and purchasers. - A duplicate deed for an existing plot or a new deed necessitated by a private sale between individuals (i.e.
transfer) can be purchased from the ICBC Cemetery Board upon request for $20. - No dumping or unauthorized disposal will be tolerated on Cemetery grounds or in the surrounding areas.
- The cemetery shall take reasonable precaution to protect owners, and the property rights of owners, within the
cemetery, from loss or damage; but it distinctly disclaims all responsibility for loss or damage from causes
beyond its reasonable control, and especially, from damage caused by the elements, an act of God, common
enemy, thieves, vandals, strikers, malicious mischief makers, explosions, unavoidable accidents, invasion,
insurrections, riots, or order of any military or civil authority, whether the damage be direct or collateral. - The right to enlarge, reduce, replace or change the boundaries or grading of the cemetery or of a section or
sections, from time to time, including the right to modify or change the locations of any part thereof, or remove
or regrade, roads, drives and walks, is hereby expressly reserved. The Cemetery reserves to itself and to those
lawfully entitled thereto, a perpetual right of ingress and egress over lots for the purpose of passage to and
from other lots. - If any memorial, or any structure whatsoever, or any inscription to be placed on same, shall be determined by
the Cemetery Association, to be offensive, they shall have the right and it shall be their duty, to enter upon such
lot and remove, change or correct the offensive or improper objects. No trees, bushes/shrubbery, large
ornaments, or gravel. For existing trees or shrubbery, etc., the lot owner is responsible for the upkeep. When
the trees or shrubbery become too large or present problems, either the lot owner will have them removed or
trimmed, or the Cemetery Board will have them removed. For existing trees, shrubs, or plants standing upon
any lot, by means of its roots, branches, or otherwise, shall be or become detrimental to adjacent lots or
avenues, or if for any other reason its removal is deemed necessary, the cemetery shall have the right and it
shall be its duty, to remove such tree, shrub or plant, or any part thereof, or otherwise correct the condition
existing as in its judgement seems best. No person shall pluck or remove any plant or flower, either wild or
cultivated, for any part of the cemetery. - Special cases may arise in which the literal enforcement of a rule may impose unnecessary hardship. The
cemetery, therefore, reserves the right, without notice, to make exceptions, suspensions or modifications in
any of the Rules and Regulations when, in its judgement, the same appear advisable; and such temporary
exceptions, suspension or modification shall in no way be construed as affecting the general application of
such. - All lot owners are required to furnish the Association with a mailing address, home and/or mobile telephone
number and email address if possible, and requested to notify the Cemetery Association of any and all changes. - The cemetery reserves, and shall have, the right to correct any errors that may be made by it either in making
interments, disinterments or removals, or in the inscriptions of memorial, transfer, or conveyance of spaces,
and also of substituting and conveying in lieu thereof other interment rights of equal value and similar location
as far as possible, or as may be selected by the cemetery, or in the sole discretion of the corporation, by
refunding the amount of money paid on account of said purchase. In the event such error shall involve the
interment of the remains of any person in such property, the cemetery reserves and shall have the right to
remove and transfer with appropriate dignity such remains so interred to such other property of equal value
and similar location as may be substituted and conveyed in lieu thereof. - Cutting and trimming grass is the largest and most costly maintenance activity of the cemetery. For the
economy of maintenance during the growing season, it is imperative that flowers and other
improvements/decorations be planted or placed along the head stones using better judgement to not impede
the mowing and trimming of the cemetery. Management or designated caretakers shall have the right to
remove any floral designs and other decorations of any kind from the cemetery if, in the judgment of the
Cemetery Association they do not conform to the standards maintained by the cemetery. If in doubt about any
decoration, please consult the Cemetery Association for information and assistance. - Any person injured on any portion of the cemetery’s grounds shall in no way hold the Association liable for any
injuries sustained. - The Association may, and it hereby expressly reserves the right, at any time or times, to adopt new rules and
regulations, or to amend, alter, revise or repeal any rule, regulation, article, section, paragraph or sentence in
these Rules and Regulations. Such adoption, amendment, alteration, revision or repeal shall be made by
resolution of the Board of Directors at any regular or special meeting. It is specifically understood that any
changes in the rules and regulations will be binding upon owners of record or any person claiming rights by
virtue of or through such ownership. Oral statements inconsistent with these Rules and Regulations made by
any member of the Cemetery Association shall in no way bind the Cemetery Association. - Questions or remarks, please contact the Indian Creek Baptist Church at (724) 455-7344.
- The Cemetery Association shall be governed by the Indian Creek Baptist Church Director’s Board. The Director’s
Board is responsible for the administration of all the Association’s operations and holdings. The Board shall
meet monthly September through May at the Indian Creek Baptist Church.
